Validity
These general terms and conditions are valid in such a case when you ("Customer") purchase a team game from the ActionTrack team games web store. As a result, you will get a start code for a specific activity that you may administrate with the limited TAZ ActionTrack online service.
No warranty
TAZ does not warrant that the use of the limited TAZ ActionTrack online service will be available for uninterrupted or error or virus-free. TAZ undertakes to repair discovered material errors of which is has been informed in writing (email to support@taz.fi), without undue delay.
TAZ reserves the right to revise the service and the contents or withdraw access to the same at any time. TAZ undertakes to notify the Customer of such interruptions in advance. TAZ shall not be liable to compensate the Customer for such interruptions.
No unlawful or prohibited use/Intellectual Property
You are granted a non-exclusive, non-transferable, revocable license to access and use the limited TAZ ActionTrack service strictly in accordance with these terms of use. As a condition of your use of the service, you warrant to TAZ that you will not use the service for any purpose that is unlawful or prohibited by these Terms. You may not use the service in any manner which could damage, disable, overburden, or impair the service or interfere with any other party's use and enjoyment of the service.
All content included as part of the limited TAZ ActionTrack service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the service, is the property of TAZ or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.
International Users
The limited TAZ ActionTrack online service is controlled, operated and administered by TAZ from our offices in Finland. If you access the service from a location outside Finland, you are responsible for compliance with all local laws.
Indemnification
You agree to indemnify, defend and hold harmless TAZ, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the limited TAZ ActionTrack service, your violation of any terms of the agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. TAZ reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with TAZ in asserting any available defenses.
Damages and Limitation of Liability
TAZ shall under no circumstances be responsible to compensate any damages that the Customer may have suffered.
Force Majeure
Neither party shall be liable to the other or deemed to be in default hereunder for non-performance or delays of the service due to causes which are beyond the control of a party and which occur after and were not reasonably foreseeable on the date of the purchase of a start code. Such causes shall include without being limited to war, acts of government, strikes, natural disasters, power failure, fire and explosions.
Changes to Terms
TAZ reserves the right, in its sole discretion, to change the Terms under which the limited TAZ ActionTrack service is offered. The most current version of the Terms will supersede all previous versions.
